Afghanistan Independent Human Rights Commission

The Afghanistan Independent Human Rights Commission was originally established under the Bonn Agreement and commenced operations following a Decree of the President of the Interim Administration of Afghanistan on 6 June 2002.

On 7 January 2004 the Commission became constitutionally entrenched following the adoption of the Constitution of the Islamic Republic of Afghanistan by the Loya Jirgah (the Afghan Grand Assembly). Article 58 of the Constitution provides that the structure and functions of the Commission will be elaborated in supplementary legislation.

In accordance with Article 58 of the Constitution, on 2 May 2005 the Commission’s establishing legislation, the Law on the Structure, Duties and Mandate of the Afghan Independent Human Rights Commission, was adopted by the Afghanistan Cabinet and enacted by the President of Afghanistan. The law accords the Commission a broad mandate to protect and promote human rights in Afghanistan. It can receive, investigate and attempt to resolve complaints of human rights violations, conduct human rights education, monitor the performance of the State as well as commercial and not-for-profit organisations and make recommendations about legislative or administrative actions.
